The agreement between you and Penny Ballad when you order a song. Plain words, no tricks.
What you’re buying
A custom song written for one person: the lyrics, a recorded song (MP3), cover art and a private song page with a gift link. We make it from what you tell us in the interview.
How your song is made
Penny Ballad uses AI tools to help make every song. The interview is a chat with our AI assistant. AI helps draft the lyrics, and the music and vocals are generated with AI music tools. A person on our team reads your answers, checks the lyrics and listens to the song before it’s delivered, and picks the best version.
Because of this, no two songs are the same, and a song can’t be made twice exactly alike.
Your order
- You need to be at least 18 to place an order.
- Prices and delivery times are on the pricing page. Delivery time starts when your payment goes through.
- Standard includes a lyrics preview. You can approve the lyrics or ask for changes, up to 2 rounds. If you don’t answer before the preview window ends, we take that as approval and keep going, so your song still arrives on time.
- Express has no lyrics preview. We use the names and facts from your interview exactly as you wrote them.
- Every song includes one free revision after delivery. Your song stays playable while we work on it.
Payment
Payments are handled by Creem, our merchant of record and payment processor. Your card statement may show Creem. We never see or store your card number. Refunds are covered in our refund policy.
Who owns the song
Once your order is paid, the song is yours. We transfer to you all the rights we have in the lyrics, the recording and the cover art. You can play it, share it, post it, use it at an event or put it on social media. You don’t need to credit us.
A few honest limits:
- US copyright law may not protect the parts of a song that were generated by AI. We can’t promise you’ll be able to register the song with the Copyright Office or stop others from copying it.
- If you upload the song to streaming services or YouTube, we can’t promise it will pass their content checks, and you’re responsible for following their rules.
- We keep a copy so your song page and gift link keep working. We won’t use your song, names or story in our marketing without asking you first.
What you tell us
Only share stories you’re comfortable having in a song, and don’t include anything hateful, unlawful or meant to harm someone. Don’t use another person’s lyrics or ask us to copy a real artist’s song or voice. We can refuse an order that breaks these rules and refund it.
Your song page and gift link aren’t listed anywhere, but anyone you give the link to can open it. How we handle your information is in our privacy policy.
If something goes wrong
We do our best to deliver on time and get every detail right. If we fall short, tell us and we’ll fix it or refund you as our refund policy says. Beyond that, our total responsibility for any order is limited to the amount you paid for it. The song is provided as is, without other promises, to the extent the law allows.
Changes
We may update these terms. The date at the top shows the latest version. The terms in place when you paid apply to that order.
